Joint Tenancy with Right of Survivorship

February 19, 2015 By Donna Ennis, Elder Law Assistant

A title that is often placed on co-owned property. At the death of one owner, the other owner will be legally entitled to sole possession of the property, regardless of what provisions are made in a Will. Joint tenancy property passes outside of probate, however, it may be severed so that the property becomes part of one person’s estate and passes to that person’s heirs.
